The Application Of Private International Law Treaty In Our Country

With the development of economic globalization,the communications between countries in the world become closer day by day.In this case,the treaty has become one of the most important tools in the international contacts.China has carried out the opening-up policy for many years.The Chinese government has signed and joined more and more treaties, especially in the field of private international law. Thus the research on the application of private international law treaties in China has significant meaning.The thesis is consisted of three chapters.The chapter one is about the summary and introduction of treaties.This chapter discusses the concepts,features and effects of the treaties,and also analyses the features,scale and classifications about the treaties of private international law.The chapter two makes a theoretical analysis about the basic problems of application of treaties,which includes the relationship of international law and domestic law,the basic principles of private international law treaties' application and the conflict of law effect between international law and domestic law.This chapter also elaborates the main modes of treaties' domestic application in the world.The chapter three investigates the present situation of legislation and judicial practice in China,and dicusses three main problems about the domestic application of private international law treaties. In the end,this chapter tries to make some suggestions for perfecting the judicial system of treaty application.
