Research On The Main Legal Issues Of Online Operators

With the development of e-commerce and prosperity, online shopping is becoming more and more popular because of its openness, convenience, low cost, high efficiency, and so on. Online business has been an efficient way to expand markets and win the competition. However, the relevant legislation of this aspect in China is relatively backward, the relative system can not fully adapt to this new operation mode, and the online operators access standard is not so clear, moreover, the tax system of the online shopping, the protection system of the online consumer are still unperfect. All of these make the regulation of online business operators become more difficult. What's more, the online business operators are secluded and virtual, the quality of the online commodity and the prestige of the online business operators is difficult to identify. Then the consumer's interests are difficult to guarantee and the development of online business is limited.This article focuses on the commercial registration, market access and supervision and management system of the online business operators. In order to protect the consumer's interests and the healthy development of the online business, a number of advices are proposed for the online business-related legal issues. Firstly, through the comparison of traditional business models and online business, the concepts, characteristic and mode of online business and online business operator are identified. The classes of business operator are defined. Secondly, the current situation of Chinese online business and online operator qualification regulatory system, as well as the existing problems in tax issues and the situation of consumer's interests'protection, is analyzed. A number of important problems which need to be solved are summarized. Finally, the advanced experience of foreign e-commerce development are analyzed and adopted. Combine with the real market situation and legislative mechanisms of our country, some advice to perfect the online operators of commercial registration system, tax system, as well as the consumer protection regime are proposed. This study can be a reasonable reference for the relevant departments of China's online business to guide the drawing up of corresponding laws and regulations.
