The Real Estate Investment Trusts (REITs) is in the process ofurbanization and resource allocation adjustments, play, driven by the upstreamand downstream industries, an important role to meet the consumer demandfor investment. Side of the realestate business capital chain tension caused by the project can not be thehealthy functioning of the other side of some investors lack the channels cannot be involved in the case of the contradictions of the industry marketinvestment returns on investments, real estate investment trust due to itsstart-up capital required is not high, production rate of concentration, to facilitate the transfer characteristics to meet the developers to seek financingchannels and the double needs of investors seeking investment income, Chinaalthough the CBRC and the Central Bank jointly prepared and interpretationof the collection of real estate investment trust business pilot managementapproach "introduced, but still lack a more detailed and practical operation ofthe Trust Law or industrial Fund Act to the relevant economic activities toregulate and guide, and the possible risks in the process of real estateinvestment trust projects rarely involved, so this study is to make up for thereal estate investment trust normative research has important practicalsignificance.This paper attempts to use of comparative study of methods of theoreticalstudy and introduced the concept of real estate investment trusts and their riskof type, by combing and causes further elucidate the value of China'sdevelopment of the system of real estate investment trusts and offshore, aswell as China's Real Estate Investment Trust the status of the risk of legalpoint of view, through a comparative analysis to explore the idea of ourcountry to build the legal regulation of real estate investment trust and riskprevention.
