The Virtual Property's Legal Protection

With the development of computer network technology, the disputes of virtual property continue tooccur in the network game, causing widespread concern in the community. However, there is a great deal ofcontroversy that how to definite virtual property and protect it with the law between academia and thejudiciary. And, related legislation is blank, therefore the player can not protect their own interests by legallylegitimate means after the occurrence of virtual properties dispute. So, there is an urgent need to study theproperties of virtual property, and other legal issues.This paper is mainly divided into the following chapters:The first chapter is to introduce the concept and characteristics of virtual property. A conclusion couldbe made that virtual property is present in the network and is a network of magnetic recording, which is theprerequisite and basis for the theory of full text.The second chapter focuses on the necessity and feasibility of virtual property protection. The analysisis mainly made through case in this chapter. The dispute cases of network virtual properties are becomingmore and more and the legislation is lagging in China, which explains the need for the protection of virtualproperty. Of virtual property as intangible property, both technically and legally there are many unfavorablefactors. Therefore I believe that, although there is a big gap in comparison with other countries, buttechnologies have had preliminary feasibility to protect their virtual property.Chapter III is mainly to introduce legal provisions of other countries and regions about the virtualproperty, and explained situation and facing difficulties of protection of virtual property in China bycomparative methods.The fourth chapter is to introduce virtual the experience of property protection abroad and combined with China'sactual conditions to elaborate recommendations of perfecting the protection of network virtual property.Summary: Due to Chinese rapid development, the perfection of Chinese legal system should keep upwith times, so as to better meet the needs of society.
