China is the largest gold-producing country and the second largest gold consumer, saving goldin China is a traditional custom。 Along with the rapid growth of national income the gold businessmarket size had a rapid development and expansion, the gold business market has unlimitiedpotential。 Commercial bank operating precious metals business can take full advantages inchannels, funding, customer resources, science and technology, and strengthen cross-market productinnovation, and provide a more comprehensive, integrated precious metals business service to bettermeet customers' growing gold financial and hedging risks。 Accelerate the precious metals businessdevelopment of commercial banks has become an objective requirement for China's commercialbanks to expand services, improve earning and enhance the ability to resist risks, promoting productand service innovation, improve the competitiveness and realistic choice。 But the precious metalsbusiness is complex, multiple, easy to breed the legal risk, but at this stage the relevant law isdistempered。 Therefore learn from foreign experience to improve China's precious metals businesslaws and regulations to prevent the business to carry out the legal risks that may arise during theprecious metals business development for the promotion of commercial banks, and no doubt it has avery important practical significance。 This article comprehensively expounded some legal issue, itexisted in China commercial banks operating precious metals business。 By drawing on foreignexperience and the author's thinking proposed the solution to the relevant problem。This article focuses on the regulatory aspects of legal issues that existed in the process ofcommercial banks operating precious metals business. Learn from foreign experience and theauthor's thinking the article proposed the related countermeasures. There are mainly four parts:1. The general information and regulatory system of China's commercial banks precious metalsbusiness. Expounded the all kinds of precious metals business and existing regulatorysystem.2. The shortage of regulatory system of China's precious metals business. List the problemlegal aspects caused by regulatory vacuum in commercial banks precious metal business.3. The general information and regulatory system of overseas commercial banks preciousmetals business. Introduction of foreign commercial banks operating mode of the preciousmetals business by comparison. By analyzing the UK, U.S. and EU regulatory policies offinancial institutions proposed the experiences that meet the China's national condition.
