| Since2008, the development of hedge fund is strong, began to walk into the field of vision of general public. Especially in Asia and other emerging market countries, hedge fund is coming viciously. In this context, what is the effective legal regulation to prevent the systemic risks of hedge funds has become the focus of attention. This paper will be a preliminary study for the legal system of hedge fund regulatory, and I will combined with the international hedge fund cases in recent years to new situations and practical experience, then make some suggestions for our country to create a hedge fund regulation of the legal system, and hope that it will benefits for the build of China's hedge fund regulation of the legal system framework:This article includes three parts of the introduction, body and conclusion. Among them, the body is divided into four chapters to prove the point.In the introduction section, it discussed the necessity and importance of hedge fund regulation in general, and leads to the reason of writing.The first chapter, an overview of the basic theory of hedge fund regulation. Objective understanding and analysis of hedge funds. The second chapter, focusing on analysis and comparison of the legal system of the various countries hedge fund regulation. There are evaluated in the current hedge fund regulatory regime, and proposed initiatives to improve the regulatory system. Chapter Ⅲ analyzes the status quo of China's regulation of hedge funds as well as its problems. China now has the institutional conditions for the development of hedge funds; the regulation of hedge funds is also required. However, the regulation of hedge funds in China has a lot of problems, resulting in the interests of investors is not protected and easily leads to large-scale systemic risk. Chapter IV, the main is envisaged the framework for building hedge fund regulatory legal system with Chinese characteristics.At the end part, the author reiterates the central point of this paper. |
