On Penalty Mitigation

According to the evolution history of punishment, it has experienced from the harsh punishment to light penalty and humanitarian process. Now more and more countries have abolished the death penalty and the other countries which retain the death penalty have also reduced and limited the death penalty. So the light punishment has become a stream of irreversible trend in the world today. Through researching the concept of punishment can better explain the light punishment. With reviewing the ancient history of punishment and comparing Chinese and foreign history of the punishment can get deep understanding to the light punishment and the harsh punishment.And then talk about the future direction of the light punishment in our country over the death penalty and related problems as the breakthrough point.This paper is divided into four parts:the first part discuss the concept and purpose of punishment for the more in-depth understanding to punishment and through the review of Western harsh penalty history to show the urgency of light punishment; the second part, analysis the development of light punishment about death penalty of penalty,and then get to know that so the abolition of death penalty, limit or reduce the penalty is the mainstream of development; the third part focuses on the value and foundation of penalty, so as to provide a strong theoretical base to the mitigation of penalty the development; the last part,discuss the process of light punishment in legislation and judicature though our country's current situation and future development so as to the development of light punishment in our country.
