The Study Of Anti-monopoly Law Relating The Concentration Control Of Operators

The concentration control of operators is increasing along with the rapid development of economy. At present, there are a lot of concentrations which have seriously impeded or restricted the competition of the market. This paper focuses on the topic of the concentration control of operators to explore a way to improve the system of concentration control of operators.In this paper, an overview of the concentration control of operators is introduced first, which involves the concept, function and classification of the concentration control of operators so that readers can have a general understanding on it. Then, through the introduction of the relevant provisions of the United States, Germany and the European Union on the concentration control of operators, advanced legal system and practical experiences available for our reference will be analyzed and explored. Moreover, the current legislation of the reporting system, censorship and exemption system of the controlling system of the concentration control of operators is analyzed here in order to make a summary of the problems and deficiencies of those systems and find the reasons why the legislation of anti-monopoly law in China is relatively lagging behind so that the concentration can be effectively regulated. In the end, on the basis of the above study, a proposal concerning the improvement of the system of the concentration control of operators is putted forward. In this paper, a proposal of developing reporting standards and improving reporting procedures for the reporting system is putted forward. As for the censorship, it is suggested that substantial damage criteria of western countries should be taken as the substantive standard of the censorship, and it is necessary to enrich the specific relevant elements and the basis of calculation. And concerning the exemption system, it advised to perfect the content in order to form a complete exemption system. Meanwhile, this paper has also mentioned the definition of the concept of the concentration control of operators and the way of improving the setting of managing institutions.
