Research On The Centralized Examination System Of Business Operators In China

With the rapid development of the modern market,the concentration of business operators has sprung up like bamboo shoots after a spring rain,which inevitably plays an important role in the economic development of various countries.This situation is more prominent in the more developed countries and the countries with rapid development of economies of scale.As a result,all countries abroad have regulated this important content in the "economic constitution" of all countries.However,our country began to organize the legislative plan of the Anti-monopoly Law in 1994,and its draft has been deliberated for more than ten years in the different opinions of all walks of life.Finally,China’s "anti monopoly law" was born in 2008.However,the law which has been in force for 11 years has not yet been amended in accordance with the times.The interim measures and regulations introduced since then have not been able to adjust and regulate China’s economic activities in a timely and effective manner.The limitations and lagging characteristics of the law have gradually emerged.With the development of economy,some operators begin to catch the loopholes of law and "skillfully" use some blank zones in the regulation of concentration of operators in China’s "Anti-monopoly Law" to achieve their commercial purposes.In this way,the limitation and lag of the legal regulation of the concentration of operators seriously destroy the normal order of competition in the market economy of our country,and cause the development and interests of many small and medium-sized operators to suffer losses,resulting in the unequal status of operators in the market economy,which will lead to the rank of competition in the market economy of our country.The order brings great challenges: on the one hand,it will destroy the competition order,and it is difficult to guarantee the implementation and effect of the law;on the other hand,the market economy can not develop healthily,and the operators will operate unfavorably,which leads to a vicious circle of consumer trust crisis and hinders the improvement of economic efficiency.Therefore,in order to have a healthy market economic order and let it develop,the rights and interests of the vast number of consumers in our country can be guaranteed.As one of the three pillars of the anti-monopoly law,the concentration of operators can be perfected.It is necessary to promote the regulation of the concentration of operators in the new era.To stabilize the order of competition in the domestic market economy,maintain the competitiveness of operators and protect the legitimate rights and interests of consumers.Based on the analysis of the present situation of the development of the concentration of business operators in China and the legal regulation,this paper studies and absorbs the advanced nature of the legal regulation of the concentration of business operators in foreign countries,finds out the problems that arise in the concentration of business operators in China,summarizes the experience of the development of foreign countries,expects the development of law in China to take less detours,and applies economics.Knowledge of social sciences,law and economics,research and explore the integration of China’s concentration of operators system,to ensure that applicable to China’s current situation,and high operational countermeasures.This paper aims to expound the following four issues: the concept and scope of the concentration of operators;the current situation and problems of the concentration of operators in China;the advanced nature of the legal regulation of the concentration of operators in foreign countries;and the methods to improve the regulation of the concentration of operators in China.Find a way for the operators to grow up in the tide of economic development and devote themselves to coping with the multiple challenges in the legal regulation of the concentration of operators in China,whether it is to the vast number of consumers,operators,China’s market economic competition order,or even to the field of anti-monopoly law and economic law.Other contents are of great significance in perfecting the legal regulation.
