Comparative Study On Japan-US And Sino-US Intellectual Property Trade Friction

With the worldwide economic and cultural exchanges increasing more and more frequently,intellectual property system becomes one of the basic conditions of modern international social economic and technical cooperation. Intellectual property protections abroad have increased prominent, leading to intellectual property trade friction as follow.Nowadays, as the economic developing rapidly, the scale of import and export has increasing expansion. China's position in the world economy is rising, the status and degree of integration into the world economy gradually deepened. So the trade friction between countries is increasing frequent. Today, the scope of friction gradually extended to the field of intellectual property right, and the forms of friction become more complicated and diversified. Among them, the trade frictions between US and China are the most typical.China's accession to the WTO, as the continuous development of economic and trade relationship between the two countries, the trade friction quantity has increased gradually. Especially the deepening of intellectual property trade friction, seriously affect the Sino-US bilateral relations and economic development. Because China and Japan in culture and customs is comparable to some extent, and 1980s of 20th century the Japan-US intellectual trade friction have some similar things with the Sino-US intellectual trade friction in 1990s of 20th century. So with the basis of Japan-US intellectual trade friction, analysis the valuable experience how Japan deal with Japan-US friction, it's high important in intellectual property rights of China's trade friction demonstrations.This article mainly adopts the method of comparison, divided the Japan-US and Sino-US intellectual property trade friction into several aspects for comparative research: including the development process, the causes and development trend of the settlement. On the basis of summarize Japan's experience response to intellectual property trade friction, from the government, enterprises and industry associations put forward three areas of intellectual property rights deal with the intellectual property trade friction.
