Study On Protecting The Rights And Interests Of Landless Farmers In The Context Of Weakness Of Agricultural Land Property Rights

Land is the material basis and fundamental guarantee of living, production and subsistence for farmers. With the development of industrial civilization and urbanization, the speed that agricultural land transforms to urban land is accelerating. Therefore, the process of agricultural land expropriation becomes an inevitable suffering for farmers. Protecting the legitimate rights of landless farmers has become the focus of the whole society. Reasonable agricultural land system is the root to protect the rights of landless farmers. Besides, agricultural land ownership is the core of agricultural land system as well as the core of protecting the interests of landless farmers. However, a series of problems caused in the process of agricultural land expropriation are concerned with the weakness of agricultural land property rights. As a result, to solve the problem of the weakness of agricultural land property rights is the core to protect the rights and interests of farmers.This article attempts to analyze how to protect the rights and interests of landless farmers in the context of weakness of agricultural land property rights, which takes the protection of the farmers' rights and interests as a breakthrough point, combined with empirical analysis of three villages in Chengdu as well as guided by property rights theory, the rent dissipation theory, exchange power theory and neoclassicism country theory. According to the analysis, weakness of agricultural land property rights leads to such problems as pricing extremely unreasonable, rent dissipation and weak protection of property rights, status inequality. By analyzing the mechanism that damages the interests of the landless farmers, try to dig the reasons and make appropriate policy recommendations.Therefore, this article claims that in the course of China'agricultural expropriation, there are at least three ways to improve agricultural land expropriation system which not only strengthens the protection of agricultural land property but also the legitimate rights of landless farmers. Firstly, clear agricultural land property rights, strengthen the agricultural land property rights; secondly, establish the third-party evaluation system; and thirdly, transform government's functions, including enhancing the protection of agricultural land property, perfect the system of agricultural land property exchange.
