The safety situation of China’s coal mine production is grim, will cause serious damage on our social and economic order, the interests of the whole society, public security, the right of miners’health life caused serious, whereby have great impact to our order, justice, efficiency, human rights and the value of law. therefore, to use the Chinese legal system regulate safety situation is emperative.Foreign major protection supervision system mechanism and safety production training system on coal producing may be learned. At present our country coal mine safety production law system is not perfect, legal laws and regulations is too simple and lack systematicand maneuverability, especially at this stage have not been developed market access system is not reasonable, relying too much on the administrative examination and approval, confusion of market access and market supervision, administration law enforcement confusion; safety production supervision system weakening, orgnaization jackknife, function is not clear, supervisory confusion, regulatory vacuum phenomenon is serious; miners’rights protection mechanism of anomie, law for mine enterprise illegal restriction failure, low cost, injured miners claim difficult to achieve; the implementation of safe production responsibility system is not in place, the division of functions is unknown, safety responsibility and the index could not be implementation; safety production training system is not perfect, training is vague and general in content, and production are out of line, form and so on to training accidents increase.The recommendations as follows:first, establish a special regulation for coal mine safety production introducing the concept of human rights as its logical starting point, increasing the miners’health right and the right of life interest Secondly, perfect market admittance system to make economic society natural resources gets reasonable configuration and raise economic benefits. Third, increasing the explore efforts to seek supervision system of safety production of coal mine with Chinese characteristics. Furthermore, we should perfect the protection mechanism of miners’rights to get a full range of protection through the establishment of a compensation committee and dual injury insurance system, and the improvement of mortgage payment system of mine risk, etc. Furthermore, we should make sure the responsibility system of safety production is well implemented and training system of production safety of coal mine is sound in enterprises, improve safety awareness, form security consciousness and reduce safety accidents in coal mine fundamentally.
