As a finite rational being, most of us dominated by the traditional concept of death detest death. Death is inevitable as the rational being’s own eigentlichkeit of possibility, and this kind of ultimate inevitability highlights the limitations of the rational being. However, with the progress of modern civilization and the changes in the concept of death in the new era, the finite rational being changes the outlook on life,so the issue of choice of life and death turns to the demands for the quality of life, the dignity of life, the meaning of existence. The innovation of modern medical technology and the improved sustainable technology, bring about the emerging demand, that is the right to die, of which the most outstanding demand is euthanasia involved the dying patients. We can’t deny the fact that, this special demand becomes the controversial issue because of involving many complicated problems in ethics, medicine, sociology, law and other subjects. Clarifying the right to die and its basic problems, can be additional demonstration on the issue of euthanasia for the dying patients, thus the demonstration can be important theoretical support to solve the controversy about the right to die for the dying Chinese patients, and realize the legalization of standardization.Foreign countries have quite mature theoretical study on the right to die, which have been a lot of juridical practice. These researches demonstrate on the right to die mainly from the right of self-determination, the principle of autonomy or the right of privacy, which indicate patients’right to choose death freely. The principle of autonomy shows respect the right to the dignity of death in practice, which is kind of independent voluntary choice based on rational basis without the external interference. Therefore, the right to die must be strictly defined on account of ending life. The right to die claims every person have the right to die,when life suffered great pain and the quality of life was extremely low, the person could end life. The principle of autonomy is based on the right to self determine, and shows patients have the independent right to make choices for the medical diagnosis, medical treatment and medical effect in medical process.
