| Land is the source of all the things, the basis of all the things, the starting point and the end. Because of that, land should be pay appropriate attention to. Currently, as China’s fundamental problem, the land issue has been given high priority of CPC Central Committee and State Council. As the development of socialist market economy and the need of socialist new countryside construction, the research on the transfer of the right to land contractual management is becoming extremely important. This paper starts from rights of rural land contracting company shares, one model of the right to land contractual management, finding the "bottleneck" of the current system under this type of transfer mechanism. And putting forward innovative proposals to regulate the behavior of rights of rural land contracting company shares.This paper is divided into five parts, and its chapter structure and main contents are as follows:Part One:Introduction. This section briefly describes the purpose, the significance and the value of this research.Part Two:Practice status analysis of rights of rural land contracting company shares, choosing Chongqing as an example. By bringing two normative documents, <Comments on the comprehensive implementation of the Third Party Congress spirit of Chongqing urban and rural development> and <Notice on the issue about the right of rural land contracting business establishment of the company shares registration>, this paper describes the specific practice situation of rights of rural land contracting company shares in Chongqing, and analyzes its significance.Part Three:Positive significance and reasonable analysis of rights of rural land contracting company shares. First of all, analyzing positive significance of rural land contracting company shares to farmers, rural areas and agriculture. Besides, carrying on the reasonable analysis of rights of rural land contracting company shares, from both the protection of constitutional rights of farmers and nature of the right to land contractual management.Part Four:The "bottleneck" analysis of rights of rural land contracting company shares.
