Research On Undercover Investigation

Undercover investigation in China, has been used to tackling the difficult and complex case, especially with the development of science and technology, criminal activities is increasingly rampant, so undercover investigation got more widely used. In the practice of detection, the undercover investigation is primarily used to cope with major crime that we can not crack with the conventional detection method. But with the diversity of forms of crime and the concealment of means of crime, some new organizational and international crime will constantly emerging, so that we have to use the undercover investigation to combat crime.Throughout the laws and regulations of our country, the law and regulation of undercover investigation is blank in our country. As an effective and the necessary means of investigation, undercover investigation really plays an irreplaceable role in combating crime and improving the detection rate. But we should also be seen, undercover investigation has considerable risks in the implementation as a secret, compulsory measure., it will not only infringe on the legitimate rights and interests of citizens and threaten the personal security of undercover police. In addition, implementation of undercover investigation measures will spend a lot of human and material resources, from the economic point of justice, whether it is worthwhile? These discussions lead to the dispute on the legitimacy of the law and theory of undercover investigation. Because of this, undercover investigation has also exposed many problems in the process of implementation. It makes undercover investigations be in an awkward dilemma. Therefore, faced with an increasingly serious crime situation, we should change our concepts and strengthen legislation to bring out the plight brought from lack of law.At the same time, the theoretical study of undercover investigation which has just started, is still relatively weak. In view of this situation, this paper analyzes the basic theory and practice of operating conditions of the undercover investigation and Combined with the practice in China, and on the basis of Learning from successful experiences of other countries, this paper put forward preliminary presumptions of constructing undercover investigation system of our country.
