The Research Regarding The Law Issue Of Capital Management Companies In The Process Of Dealing Assets

Alarge number of financial nonperforming loans (NPL) has already seriously held back the nation’s marketing process. Research on the problems of law existing in the process of disposal of the NPL not only can advance the financial law system, fasten the financial innovation in the market of asset, but also has important practical meaning for eliminating financial risk and driving the reform of financial system.Based on the practical experience for years, the author in this paper tries to research the methods of comparing and integrated analysis to generalize and summarize the practical problems of law and the problems which cannot be solved under the current law system, both exist in the process of disposal of the NPL. The author also hopes that the research in this paper could be an inspiration for the research of the same problem, and could also be a suggestion for the establishment of relevant laws and regulations.In this paper, the author reveals the general legal principal of disposal of the NPL by introducing the concept and features, the production and cause of formation, the channels and practical methods of disposal, and legal environments,etc.At the same time, for engaging in disposal of the NPL for years, the author has rich working experiences in this field, alaysised the legal problems of NPL in financial asset management corporations, and get great acheivement in reserch of NPL’s relistic and regular legal affairs cases and problems.Through the above comparison and generalization, the author thinks over the legislation of proposal of financial NPL of financial asset management corporations, puts forward that special law should be formulated for the proposal of financial NPL, and at the same time,gives some specific suggestions for legislation.
