As the main kinds of crime against property, the concept about theft and embezzlement had been regulated in the Criminal law for a long time. Meanwhile, there are many researches focus on this topic. But, there are still some key problems when we are talking and using these two concepts. In fact, when we treat possession as ownership, it is difficult to distinguish these two concepts. However, possession is not equal to ownership completely. Therefore, some problems would met when we using these two difficult concepts as the same concepts. There are four parts in this paper. Part one is mainly focusing on he concept of crime of theft and its characteristics. Part two analyzes the concept of crime of embezzlement and its characteristics. Part three, the main body of this paper, analyzes the differences from several parts between the theft and embezzlement. Especially, this part uses many real cases in judicial practice. Part four, the author draws the conclusion.
