Globalization Under The Condition Of Legal Protection Of Traditional Cultural Security

The existence of culture is a prerequisite of a nation’s existence and development, particularly the traditional culture. It not only accumulates all the wisdom and civilization of a nation and a country, but also holds all the sustainable developmental cultural genes of the country’s future development direction. In the current globalized international environment, on one hand, with the further expansion of global communication, a strong US-led Western culture spreads rapidly in the world. Western nations tried to expand the economy control to cultural penetration and control. On the other hand, how to communicate and contact with different cultures and selectively integrate and absorb foreign cultural achievement so as to develop Chinese culture well, is the problem that we have been trying to solve.In the complex environment, China’s traditional culture security suffers severe challenges. China’s modernization process will lose the foundation of history and the ability to better promote if without the heritage and development of the fine traditional culture. It’s important to maintain traditional culture. As the traditional culture is facing a severe test, protection from laws is an inevitable choice. This paper concludes an overall analysis based on the conditions of globalization to the security of China’s traditional culture, a theoretical analysis and exploration based on law and legal aspects to the traditional culture security, and some related legal response. The key point lies in the exploration of laws and legislative status towards China’s traditional culture. This paper is divided into five sections.The first chapter discusses the influence of globalization on China’s traditional culture. It describes the concept of globalization and traditional cultural security, the positive and negative effects of globalization to China and the significance of law protection for traditional culture.The second chapter discusses the extra-territorial legal measures for the protection of traditional culture. It includes the experience and measures of Western countries, East Asian countries and regions, and the related measures of UNESCO.The third chapter discusses the important relationships and handling measures in the legal protection of traditional culture. It includes the protection of traditional culture and cultural diversity, traditional culture inheritance and innovation, and legal protection of traditional cultural rights and civil liberties and the principles of their treatment. The fourth chapter discussed the current status of China’s traditional culture security and the lack of legal protection.The fifth chapter, on the basis of the first four chapters, proposes legal measures to safeguard the China’s traditional culture security. It describes mainly about formulating strategy to speed up and create a favorable legal environment, perfecting legislation to build a legal system for national traditional culture security, and strictly carrying out law requirement to protect the traditional culture security.
