Culture is a nation's banner of thought and symbol of spirit. Its survival is the presupposition and conditions of a nation's survival. Progressive culture is part of overall national strength, and the solid foundation of its security and national unity. The 21^st century witnesses international informationalizaion and the acceleration of economic globalization and the promotion of international communication and cooperation, so a nation's culture security is becoming more and more prominent and receives great concern and attention from all walks of the society and government. It is an important cultural proposal put forward under the conditions of economic globalization. But as far as China's culture security is concerned, there are few grounds for optimism.A nation's culture legislation and juridical system play an important role in its security as well as other elements affecting national security. A culture legal system which does not meet the requirements of a nation's culture security can not provide harmony and order for the development of a nation's culture and a culture legal system without order would not guarantee the security of a nation's culture, including public culture.Our country's legislations on culture are not scientifically systemic. And so far, no essential legislation has been passed to protect culture, and culture legislation is not perfect or systemic. There is no in-depth academic research into legislation of our culture and its security. Some research only has made analysis of phenomena or is only analogical. It does not make a systemic analysis from multiple perspectives, nor does make an analysis of factors affecting our culture security, or theoretical analysis of measures to protect culture or historical comparative analysis or systemic analysis of strategy, or the interaction between it and overall national cultural strategy and obligatory strategic strongpoint.As a result, from the perspective of culture legislation, research into our national culture security, particularly under the conditions of globalization, is not only a prospective historic area deserving interest, but also makes a theoretical preparation for alert system of perfect, scientific and effective national culture security and protection and therefore is very realistically useful. National culture security is concerned with various legislations, including public law and private law and social law, domestic law and international law. It is also concerned with macro control of legislation and micro adjustment of legislation. It is concerned with legislation and jurisdiction. It is concerned with legal theory and practice. From the perspective of culture legislation the present thesis is focused on 'maintenance of our national culture security under the conditions of globalization', making an analysis of several aspects, such as the historical background of national culture security of china, cultural sovereignty and national culture security, the present situation of our national culture security, the present situation of culture legislation, protection of China's culture today—involving legislation concerned and so on..
