On Improvement Of The System Of Arbitration Challenge In China

Arbitration Challenge System embodies the arbitration justice value.It has important significance for perfecting the arbitration mechanism, promoting the improvement of arbitration, and ensuring the arbitration justice and parties’ legal right and benefit. The Law of Arbitration has never been revised since1994, and the legal provisions is imperfect. It is imperative to explore and research how to improving of the System of Arbitration Challenge in China.The thesis is composed of four chapters. The first chapter analysis of the present Legislation Situation, implementation situation and the Causes of problems. The second chapter talks about The necessity of improving of the System of Arbitration Challenge in China,and establish the concept of "Justice and independent" base on the particularity of the System of Arbitration Challenge. In chapter three, the author comments the other countries’ and areas’ System of Arbitration Challenge from the subject, the cause, the procedure and the remedy which we can use for reference. In chapter four,The author puts out his several proposals in improving of the System of Arbitration Challenge in our country separately from the subject, the cause, the procedure and the remedy and the related system.
