On September11,2009, American President Obama announced thatAmerica would charge punitive tariffs on the cars and light trucktyreswhich were imported from China. This is the first time to imposepunitive tariffs on Chinese goods by using "special safeguard clauses" ofU.S.A. Under the present international situation, China must strengthenthe study on safeguard measures to avoid restrictions of specificsafeguard measures from other WTO members. This is also the purposeand meaning of the paper.The main studying process and way of the present are asfollows:firstly, the essay reviews the historical origin and evolution ofspecific safeguard mechanism, and the process original applied. Secondly,on the basis of respectively expounding the brief conception of WorldTrade Organization’s safeguard measure and specific safeguardmechanism, the article analyzes the difference between the WTO safeguard measures and specific safeguard mechanism, further analyzesthe application and the relevant revenge mechanism of special safeguardmeasure to WTO. Then analyze the relationship between China and thespecific safeguard mechanism to WTO, and pay more attention on theAmerican special safeguard measure. Thirdly, the essay reviews Chinatyre case with America, discusses and evaluates the legal problemsinvolved in this case.It will help to deeply understand and use the WTOregulations toprotect China’s relevant domestic industries.
