| Agricultural products trade is a very sensitive issue in the field ofinternational trade. All countries pay great attention to the protection ofdomestic agricultural products and adopt many agricultural tradeprotection measures. Special agricultural safeguard is set in Agreement onAgriculture in the Uruguay Round. For historical and legal reasons, thescope and conditions of special agricultural safeguard has been largelyrestricted, so the protect for the agricultural products of developingcountries is far insufficient. China also has no right to use the specialagricultural safeguard. In order to protect the agriculture of developingcountries, G33raised a proposal on special safeguard mechanism in theagricultural negotiations of Doha Round. The serious differences betweenparties led to the failure of Doha Round. Though parties could not makean agreement, it is believed that the special safeguard mechanism issuewould play a vital role in the coming negotiations.By the method of theoretical analysis and comparative analysis, this essay does research on the current special agricultural safeguard, describesthe necessity of establishing special safeguard mechanism. What isspecific in the essay is that on the basis of introducing the December2008Draft Agricultural Modalities, this essay analyzes the shortage of this draft.This essay presents personal options on the possible position of China inthe issue of special safeguard mechanism.The first part of this essay briefly analyzes the current domestic andforeign researches on special safeguard mechanism and points out theshortcomings in these researches. Then it presents the problems to besolved in this essay, which is the innovation of this paper.In the second part, this essay puts forward the necessity of a newspecial safeguard mechanism by studying on the legislation and practice ofcurrent special safeguard provisions.Then, the third part summarizes the main arguments on specialsafeguard mechanism by introducing the process of negotiation on specialsafeguard mechanism and different views of main parts. In the third part,this essay analyzes the December2008Draft Agricultural Modalities and points out the perfection on this subject’ main structure. Then, this papermakes several suggestion on the next draft based on this one.In the final part, this essay reviews China’s standing in thenegotiation on special safeguard mechanism, summarizes the mainproblems which China confronts. Then, based on the current situation ofChina’s import and export of agricultural products, it gives some advice onhow to solve these problems. |
