Perfection Of Third-party Mediation Mechanism Of Medical Disputes In China

In recent years, with the development of hospital reformation and the growingawareness of people’s rights, there is a rising trend of medical disputes in China. Forexploring a mechanism of medical dispute solution under the situation of our country,This thesis by method of literature research, analyzed the status of medical dispute nowin China, pros and cons of existing “three ways of the medical dispute solution”, andNingbo implementation experience of third-party mediation mechanism of medicaldisputes. It was thought that third-party mediation mechanism could make up for “threeways of the medical dispute solution” and resolve medical dispute effectively, accordingto my practice of medical dispute mediation for a decade, though there are also someflaws. Finally, I advanced the specific recommendations of perfecting the third-partymediation mechanisms of medical disputes.This article is divided into the following five parts.Part one: Introduction which included the issue,perspective and meaning of thestudy。Part two: medical dispute and medical dispute solution mechanism which includedthe concepts, features and the status of medical dispute solution mechanism in China.Part three: the exploration of third-party mediation mechanism of medical disputes inChina, which generally described third-party mediation mechanism of medical disputesandthe exploration of NingboPart four: recommendations of perfecting the third-party mediation mechanisms ofmedical disputes.For the problem of the third-party mediation mechanisms of medicaldisputes,I suggested to improve the legal system of resolving medical disputes, set upspecial centers to resolve medical disputes and establish corresponding mechanisms.Part five: conclusions.
