Study On The Relationship Between The Arbitration Institutions And The Arbitrator

With the issue and implement of arbitration law of the People’s Republic in1994,arbitration made a speed development and great progress. Nowadays, theories of arbitrationare fruitful, number of the arbitration commission is growing, arbitration cases are increasing,and all kinds institutions of arbitration system gradually perfected.According the relevant law, only institutional arbitrations be admitted in our country.Arbitration institution involves the relationship between arbitral institution and arbitrators.This not only affected the rights, obligations and responsibilities of arbitrate agency andarbitrators, but also the improvement of arbitrate system.On the analysis of the relationship between arbitral institution and arbitrators, we defineit contractual,. Based on this cognition, we put out the constructive suggestions of arbitralinstitution.This paper is divided into three chapters. We try the best to discuss the arbitration legalrelationship in a whole and overall shape. The main contents are as follows:Chapter1: Introduction to arbitral institution and arbitrators. This part is about thearbitration agency and its classification, concepts and basic rights and obligations ofarbitrators, meanings of defining the relationship between arbitration agency and arbitrators.Chapter2: The relationship between arbitral institution and arbitrators: contractualcooperative relationship. On the basis of discussing the related theory, the author puts forwardhis own understandings, and also discusses the status of arbitrators and arbitration, essence ofarbitration and the contractual of arbitration agency and arbitrators, cooperative relationshipbetween arbitration agency and arbitrators. Finally, we determine the relationship contractualand moreover give some connotation about it.Chapter3: Real value of defining contractual cooperative relationship. On thecontractual relationships, we put forward to discuss the rights and obligations betweenarbitration agency and arbitrators, furthermore, the responsibility that they shall be take to theboth parties and themselves. At the end, based on the ahead recognization, the author putsforward some constructive suggestions to the relative arbitration system.
