Since the industrial revolution, our society and technology has obtained constantdevelopment. Meanwhile, we are facing the problem of worsening environmentalquality. Among the many pollution issues, noise pollution allows no neglect, and isregarded as one of the world’s four main kinds of pollution, which together with water,air and solid waste pollution. Air pollution being a serious problem threatening people’sphysical health and living standard, each nation is on the way of exploring theprevention and control of it.China enacted Law of the People’s Republic of China on Prevention and Controlof Pollution From Environmental Noise in1996(here after the law). The enforcementof this law is a milestone in our long journey of prevention and control on noisepollution, and also set a foundation for the completement of laws about environmentalprotection in China. However, it has been more than ten years since the enaction of thelaw. During this period, many new problems of noise pollution has emerged. Increasingcomplaints on noise pollution and various disputes resulting from noise pollution makeus realize that the law cannot match the development of the society any more and needsan urgent revise. For this reason, the author of this paper tries to provide somesuggestions on the completement of prevention and control of noise pollution in citiesfrom the perspective of legislation, enforcement of laws and justice. All the suggestionsare based on China’s basic conditions, successful experience from other nations alsobeing assimilated.The whole paper can be divided into four parts. Part one gives a brief introductionon the manifestation, harm of noise pollution in cities and theoretical support ofpreventing and controling noise pollution in cities. In part two, a evaluation and analysison the law is present. The third part is a comparison and contrast of the system of noisepollution prevention and control between China, Germany and Japan, the purpose ofwhich is to explore how can China learn from Germany and Japan. In the last part,suggestions from the angle of legislation, enforcement of laws and justice are given tocomplete and improve the prevention and control system of noise pollution in China.
