During the history of Chinese and foreign media development, the undercoverjournalism has been frequently used. In recent years, the issues arising from theundercover journalism become a topic of concern of the society, especially the jurist. In2011, the News International phone-hacking scandal in the UK even directly led to theclosure of the News of the World on10July.What is the reality and legal basis of the undercover journalism? What difficultiesdoes the undercover journalism face in current China? How to regulate the use ofundercover journalism from a legal point of view? These are what the thesis will dealwith.In the first part, the thesis analyzes the basis of the undercover journalism from theprospect of reality and jurisprudence, pointing out that the undercover journalism willhelp to vividly reflect the social reality and enhance the media’s competitiveness.Meanwhile the thesis aims at finding the legal basis for the undercover journalism fromthe freedom of expression, the public’s right to know and supervision by public opinion.In the second part, the thesis states the conflicts between the undercover journalismand privacy, reputation, and national security, which also lead to legislative proposals inthe following part.In the third part, the thesis puts forward the legislative proposals for the regulationof the undercover journalism, covering the procedural and substantive law, defenses andlegal liability.After the Party’s Seventeenth Congress, China’s cultural industry enters into a newperiod of rapid development and becomes a new growth point of China’s nationaleconomy, which means a golden opportunity for cultural reform in the next years.Timely and effective regulation of the undercover journalism will promote the healthydevelopment of China’s media and information industry, remodel the credibility ofChina’s mass media and be suited for the trend of socialist cultural development andprosperity.
