On Rural Land Contract And Management Rights Trust

The agriculture is the foundation of national economy in our country, the core of agriculturequestion is the land. As the development of agriculture, part of developed economy area ledthe trust system into the transference of the rural land. So, the rural land trust comes intobeing our country.This paper based on the necessity and feasibility of rural land contract and management,according the law and to form the concrete systems of the trust that accords with thesituations in our country relying on the current legal frameworks.This paper consists of three big parts: foreword, text and conclusion, of which, the text partincludes four parts.Part one discuss the basis question of rural land trust. First of all, explain the meaning oftrust, characteristic. Then discuss the concept and feature of rural land trust and currentsituation. First it introduces the main methods and their limitations of land contractualmanagement right move in our country and gives the objects, and then explain the currentsituation of rural land trust.Part two mainly discuss the necessity and feasibility of rural land contract and management.Necessity contains four: be good at the trust advantage play, to realize the reasonableutilization of land resource, Implementation of land policy in our country, protecting thepeasants ’ interests in property. Feasibility are theory, law and practice.Part three is the core of this paper: the construction of rural land trust. According to 《TrustLaw》 and the feature of land, analyzes the clients rights and obligations of the trustor,trustee and beneficiary. Then discuss the management right of contracted land trustresponsibilities of the relevant institutions. And made the operation mechanism of the landtrust.Last part analyses the system of contractual operation right of land trusts to establish relatedmeasures developed. Mainly from the perfection of the legal system, of the responsibility ofthe Government, the land owners supervise establishment of rural social security system andmade several expositions.
