Creative Industry In Our Country Legal Regulation And Thinking

With the arrival of the times of Knowledge-based Economy, the economic benefit which creativity brings has been recognized by countries all over the world. Since the government of UK first established the definition of’Creative Industries’ in the<Creative Industries Mapping Document 1998> and start to promote the development of Creative Industries, this industry of which the essential power is creativity has increasingly become the key part of the industries development of countries. As one of the important forms of the development of Creative Industries, the Creative Industry Park gradually formed and developed flourishingly. A lot of Creative Industry Parks with special characteristic, leading industry and whole industry chain have formed in America, France, Germany, Japan, Singapore and Korea during over 10 years. Moreover, an integrated system of administration mechanism and legal protection of industry, which containing plenty of laws, regulations and rules of the market administration of Creative Industries, intellectual property rights protection, layout and management of the Creative Industry Parks, support and encouragement and etc., has also established gradually.The long history and abundant culture of China provide the good foundation for the formation and development of Creative Industry Parks.In 2006, General Office of the State Council of PRC issued the <Culture Development Program during the National 11th Five-Year Plan Period> to raise a motion to expedite the building of Creative Industry Parks, which upgrade the promotion of Creative Industries through building the Creative Industry Parks to the national stratagem of industry development. However, as the commencement of Creative Industries in China is a bit later, and the theory research is not consummate yet, there are lots of lacks and absences on legal regulation of Creative Industry Parks, which baffle and affect the development of it. Accordingly, considering the present and trend in future, forming a legal system frame accordant with the development of Creative Industry Parks in China will make further promotion to the healthy development of Creative Industries and Creative Industry Parks.In this study, I firstly introduce the definition and its character of Creative Industries and Creative Industry Park, and some successful cases of Creative Industry Park overseas, and enumerate the experience of other countries in legal regulation of Creative Industry Park through illustration. Then, based on the actual state of development of Creative Industry Park in China, I analyze the present legal regulation of Creative Industry Park in China and conclude its lacks and problems existing. Finally, I offer some advices to the improvement of legal regulation of Creative Industry Park of China based on the actual situation of our country.
