System Research Of Power Of Relatively Concentrated Administrative Punishment

The power of relatively concentrated administrative penalty system is an important innovation during the process of China’s opening up and reform. In the mid-1990s, a stage of relatively complete legal system in China, China’s social management faced a series of new challenges, which led to huge demand of reform of administrative law enforcement. In this context, the power of relatively concentrated administrative penalty system came into being. Through the implementation of the system, many issues in the administrative law enforcement were improved, such as repeat or alternative law enforcement by different administrative departments, difficulty in law enforcement running smoothly and law enforcement of disturbing residents. The level of law enforcement and efficiency were also improved. However, due to the weak legal foundation and defects in practical mechanism, the power of relatively concentrated administrative penalty system met a series of problems.In this paper, the approach of theory combining with practice is adopted. The paper begins with the administrative law theory, and then with 10 years of law enforcement practice in China, the practical effects are discussed. Based on the discussion, the basic point of view of the paper is put forward:the power of relatively concentrated administrative penalty system is in the right direction but the system still needs to be improved.In exploring the theory and practice problems the system facing, the corresponding enhancements are proposed both in the theory and practice way. In this paper, the focus is not on the merits of the power of relatively concentrated administrative penalty system, but on exploring how to improve the implementation framework of the system and how to enhance the implementation efficiency of the system under current condition in China. This paper aims to make the system to be more scientific, rational and efficient, and enables the system to make greater contribution to promote the administrative and legal system in China.
