A Research Of Constructing Trade Remedy Insurance Legal System In China

Since joining the WTO, our country and nearly every country all over each continent in the world have established trade relationship, from developed country to developing country, from traditional markets to emerging markets, formed a multi-level, diversified economic and trade pattern. At the same time, China has also become the main object of the international trade protectionism and friction in World Trade center. The situation that China is initiated trade remedy measures frequently, not only caused the current huge losses to the export enterprises of our country, but also directly affect our future share and profitability of the global market.This article first analyzes the situation of the trade remedy measures taken by the other countries which our country is facing, and its reason; and then tries to prove the necessity and the theorization of building trade remedy insurance legal system in our country; finally puts forward the framework of system designing and implementation mechanism. Trade remedy insurance legal system was established to correct the "dislocation pattern" of the subject of dealing with the international trade remedy measures, share and compensate for the risk and loss of oversea enterprise caused by trade remedy measures, reduce cost and improve the responding rate, thereby stabilizing and promoting the export trade in goods.
