Study On Specific Standard Of Subsidies And Countervailing Measures

With the development of international economy, governments use subsidies as a tool of economic policy. However, subsidy has a dual property. On the one hand, it is a kind of policy tools which rapidly promote development of the economy; On the other hand, it is a kind of non-tariff barriers hindering the development of international trade. In view of this reality, agreement on subsidies and countervailing measures (SCMA) ues specific standard to mearsure whether a subsidy to take countervailing measures.Specific standard is an important concept in the system of subsidies and countervailing. On the one hand, it respects the economic autonomy of governments; On the other hand, it avoid the resources allocation distortion causing by improper subsidies through collecting countervailing duties from special enterprises and industries which accept the subsidies.This paper puts forward some advices about how to perfect the system of subsidies and countervailing through the analysis of the SCM agreements and Europe law about Specific standard. Besides preface and epilogue, the text is divided into the following four chapters:Chapter 1:The summary of the standards of the subsidies and countervailing. As a basis of this whole paper, it mainly discusses the system of subsidies and countervailing,and introduces the definition of countervailing and subsidies, the generating causes of countervailing system, the related international law origin.Chapter 2:It mainly discusses how to measure specific standard.Firstly,it introduces four principles of judging specific standard in the SCM agreement. Secondly, dicusses the specific problems about specific standard through analysing the cases of the United States and the European Union.Chapter 3:It discusses the judgement of specific standard in countervailing domestic legislation of the United States and the European Union. Through analysing the cases that the United States investigate the products from china, illustrate the judgment standard of specificity in practice. And on the basis of this, puts forward the countermeasures for our government and enterprises how to deal with countervailing investigation.Chapter 4:Specific standard in China subsidies and countervailing system. Combined with the specific standard analysis discussed before, illustrate the present situation of Chinese subsidy policy and existing problems. On the basis of this, puts forward some legislation suggestions for our government.
