The Research On Strengthening Chinese Populace’s Consciousness Of Rule Of Law

In the past two decades, the promotion and popularize of law have already beenlaunched. However, the consciousness of rule of law among our populace is stillweek,, since China was a ruled by man society in such a long history. People have noenough respect to law. They can neither guard their rights nor judge society eventswith law. Populace’s consciousness of rule of law is the foundation of a legal system.With no doubt, the lag of consciousness of rule of law has become the bottle neck ofthe legal system building in our country. Therefore, expending consciousness of ruleof law becomes the highest priority to build a society ruled by law. To China, it isespecially necessary to study on the consciousness of rule of law, since China was aruled by man society in such a long history.This article studies on the consciousness of rule of law of Chinese populace.Based on existing research, it gains a conclusion that the consciousness of rule of lawis still not well expanded among the populace in our country. It also gives views andsuggestions on how to strengthen the consciousness of rule of law of populace. Thisarticle consists with five parts:The first part is an introduction of this article. It gives the background and thesignificance of the research. It also introduces current research achievement on thesame topic of both domestic and abroad, measure of research and potential innovate.In the second part, the article interprets the meaning of Rule of Law, andexpounds it from the aspects of concept, characteristic, and gradationThe third part is an analysis of current state of Chinese populace’s consciousnessof rule of law. The author concludes the results of existing researches on this issue,and investigates different group of people including farmer, cyber users and college students. The conclusion is that the consciousness of rule of law is still not wellexpanded among the populace in our country. This conclusion is consistent with theexisting opinion in the field.Part four is an economic analysis of law on the course of the current situation. Inauthor’s opinion, the main course of the current situation is that there is an alternativeof law–power of relationship. It costs less that people making profit using power ofrelationship instead of law. Therefore people refer to solve arguments using power ofrelationship rather than law in reality. Author here compares these two powers usinggame theory and cost-benefit analysis.The last part is suggestions on how to strengthen the populace’s consciousness ofrule of law in our country from economic aspect based on former parts of the article.From view of law itself, People’s Congress should strengthen the construction andimprovement of the socialist legal system，provide better legal products. From theaspect of cost-benefit analysis, populace should be provided with more legalknowledge which is more convenient and more pertinence. As to the alternative of law,the party and government should work harder on combating corruption and upholdingintegrity，raise the cost of power of relationship, so that to lower the competitivenessof power of relationship. Besides, the market economic reform should be continuallydeepened, to provide a steady foundation for a society with rule of law.
