Study On Some Legal Issues Of Guarantee Insurance

In the1990s, guarantee insurance came to China from abroad. This system isdeveloping in China. One of the most typical ones is real assets load, installment bondand automobile consuming load bond. Guarantee insurance has its own uniquepositive significance, but of course it is also not perfect. It appeared for a very shorttime. And it isn’t stipulated in any relevant laws or regulations. Because of all theimperfections of the guarantee insurance, not only is the theoretical circles orpractitioners of this system have the different point of view. In recent years, guaranteeinsurance has gradually been general concern. There are many articles which studiedthis system. So I think not only from practice, but also in theory, researching theguarantee insurance has a great significance.The paper is divided into three parts. In the first part, I will introduce theconcept of guarantee insurance, its characteristics and its development in variouscountries and areas. From these basic theories, we will have a preliminaryunderstanding of guarantee insurance.The second part is the emphasis of the whole article. That is the nature ofguarantee insurance. Because nowadays the most point at issue between the practiceand theory is the nature of it. I will describe it from four parts.In the third part, I will introduce the current situation of guarantee insurance.Then I will give my suggestion about it from two parts.
