Legal Studies In The Transaction Of Artwork Shares

In August2010, the transaction of artwork shares worked by YangPeijiang was launched in Shenzhen culture exchange, it is a new product and proclaim a new model in art trading formally birth. Generally speaking, the meaning of the transaction of Artwork shares is culture property exchange or culture art exchange (hereinafter referred to as "the exchange") artwork shares is to trade the virtual share of the property right publicly as buying and selling of stocks, which is needed to identify and estimate. The resolution will enjoy after according to share ownership in securities trading system in a similar way, the listed for publicly traded.At present,"by copy of is considered the legal theory foundation on of the transaction of artwork shares by every culture exchange. However, this trading is beyond of the traditional meaning of "by copy of" due to its commercial law character. Meanwhile, the securities regulatory authorities do not put this trading in to their supervision. There are many troubles happened due to the legal gaps and supervision lacking. Some weaknesses are shown due to the lack of the trade system in the transaction of artwork shares. To improve this system, the exchange has to revise the rule of transactions, again and again. This makes a serious of new troubles.Take Tianjin culture exchange and Zhengzhou culture exchange with influence at home as an example, this paper puts forward the idea how to analysis the legal issues in this trading, such as supervision, insurance, judicial practice, and how to protect interests of investors by reading the legal document made by them. Based on the combined analysis of "State Council’s decision on inspecting and putting the all kinds of exchange in order to guard against the financial risk", this paper put forward some ideas to realize this trading legalization, to normalize and health.
