Abstract/Summary:
The Sales of Infringing Copies Crime is a very common in our intellectual crime. The protection of legal interests is complicate, including the copyright owner of copyright and the national intellectual property management under the market economic order, since the charges set by multiple constantly perfecting judicial interpretations. The scope of this crime is particular,which is the 217 of the criminal law of four types of replica. At the same time, we should be noted in the judicial practice, according to the source of the infringing reproductions and different constitutes to the evaluation of the act. In addition, rental behavior is not the legal behavior of the crime. That is limited to sales. The “copy” of the distribution and sales of this crime may be at the same understanding.
