In consumption of insurance transactions, there is disparity between the insurer and the insured’s ability. so the insured’s understanding of Insurance contract content mainly depends on the instructions made by the insurer. And the insurer uses the insurance contract to shirk responsibility or fraud, so the insured lose confidence in the insurer in the insurance industry. In such a case, the definition of insurer’s special obligations becomes a key research direction of the field of law. Only when Legislators clearly define the insurer’s special obligations, is this system operational, and thus is the insurance industry stable, health, long-term development. View of this, I use the definition of insurer’s special obligations as the discourse topic, and write this article, hoping for contributing to China’s insurance laws. The article use empirical analysis, comparative analysis, literature analysis. Article arranges the essay structure according to asking problems, analyzing problems and problem-solving syllogism logical.
