Analyzing Why It Is Difficult For Off-farm Workers To Sure For Industrial Damages

From the1980s and1990s on, urbanization in China develops unprecedentedly. Off-farm workers play an significant role in the progress of the urbanization in China, and they have become an important component of Chinese industrial workers. Since they are Chinese citizens, they should equally enjoy rights and obligations in accordance with the Constitution of the People’s Republic of China as others.However, due to historical and social reasons, Farmers in China are always a vulnerable groups. Especially, off-farm workers coming from the farmer, are a large part of the vulnerable groups in China. Because of low educational level, poor labor skills as well as influence of the inherent city system and ideology, off-farm workers have not really owned the acceptance and recognition of the society in cities, and cannot enjoy as equal social status and treatment as urban residents do.They are subjected to too much discrimination and inequality.This article focuses on the various problems Zhang Yuemei encountered in the lawsuit claims, analyzing three main factors,namely:the situation and problems of off-farm workers’legal status, the challenge to adduce evidence for Off-farm workers,the difficulty to carry into effect of a court judgment. According to my exploration to self-experience of Zhang Yuemei’s industrial injury compensation lawsuit litigation, combined with many scholars’valuable theoretical achievements, I put forward some suggestions on how to improve the existing system,find the solutiones of all levels form legislative, judicial, law enforcement,and how to better protect off-farm workers’rights and interests. The author aims to attract some better ideas. Hope that the jurisprudence can pay more attention to off-farm workers’industrial injury compensation lawsuit, and find their solutions as soon as possible.
