Li Changkui Intentional Homicide Analysis

English abstract:Li Changkui’s rape homicide case has more controversy than others in recent years. The law field has made discussions about this case on the cognizance of surrender, the application of national policy and laws, the qualification of the facts, the restart of the retrial procedure and such a series of questions, which has specific significant meaning towards solving the related problems in actual judicial practice existed a long time. This not only provides the theoretical support to the judicial practice, but also makes for China’s judicial reform and perfecting the relevant laws and regulations, especially has a significant meaning for the surrender in the criminal law and the criminal procedural law, the related questions of the retrial restart, and maintain the justice of law and social stability. The people’s court should keep independent surrender, and has a deep understanding of the connotation of the law of our country, in order to give full role of the criminal law.
