Recently, under the pressure of anti-bribery work, the naked mutualtrades between money and power are gradually transferred to new typesof bribery, such as sexual bribery, information bribery, feeling bribery,options bribery and so on, which are not so obviously to be spotted.These types of bribery are more difficult than traditional money briberyto be spotted and investigated, and they are named “recessive bribery”. Inorder to meet the increasing demand of controlling “recessive bribery”,some new regulations like “The Standards of Honest Administrative forLeading Cadres in the Communist Party of China” were unveiled and theSupreme People’s Procuratorate also issued “Notice of Further IncreasingStrength to Investigate the Crime of Bribery” to target their objective toblock the source of briberies and to effectively contain them to spread.However, a consensus and fact is that there are loopholes in the regulationof Crime of Offering Bribes, making it difficult to satisfy the need toinvestigate various briberies. Therefore, the conclusion can be reachedthat the Crime of Offering Bribery cannot be radically controlled unlesssome adjustments of the legislation are taken. And the changes of policieshave little help. This essay would focus on “recessive bribery” and tryingto study related issues of the Crime of Offering Bribery to put forward theconceive of improving bribery legislation.
