Chinese Ancient Marriage System Affect On Both Sides Of The Taiwan Strait

Humans pay attention to marriage so much, because it relates to the productionof human itself. The human to continue and the family to development both lie on therelation between the men and the women by marriage finally. folk customs after manymodifications in social change, but we can still find the shadow of traditionalmarriage system in the legislative changes. So, when we discuss the formation ofcontemporary marriage system between Taiwan and mainland, we must pay attentionto the evolution of traditional marriage system, the changes of the marriage system inhistory, the various influence factors and styles of the marriage ceremony, includingits relationship to the folk marriage customs today.In the paper,"the marriage system is refers to the establishment and divorce ofthe marriage, the rights and obligations between husband and wife, so therelationships between parents and children, and other relationships between closerelatives family including adoption, guardianship and raising are not involved.theresearch methods of this paper are history research method,analysis research methodand the comparison research method. On the basis analysis of the differences andsimilarities to the marriage law on both sides,we will probe into the influence of theancient marriage system to our contemporary marriage system in legislation andcustoms, and then we will research the source of contemporary marriage system thatis the content of our ancient marriage systemThe Introduction includes the appearance and the evolvement process of ourtraditional marriage system. which introduces the main content of our marriagesystem in both sides from the adjustment styles of our existing marriage systemThe text is divided into three chapters.The first chapter, The common source――the main contents of the marriage inancient China, On the analysis of the marriage system and the article marriage law inour country, We get the three basic principles of China’s traditional marriage systemthat are the combination of the ceremony with the law, considering family patriarchalclan as the center, the patriarchal system, and Male department for center lineage.Finally，we draw the conclusion of the same source of marriage in Taiwan and themainland from the aspect of history and system.The second chapter, The effect of our ancient marriage system on thecontemporary marriage system. We analyze the situation in mainland China andTaiwan from the Angle of law and the custom, according to the order of engagement,marriage and divorce.The third chapter, The analysis of the reason why there are difference andhomology of marriage system in Taiwan and mainland. We will analyze the situationof the marriage system both in mainland and Taiwan from the history and system soas to find out the differences and similarities between contemporary marriage system in both sides.
