Since the reform and opening up in Vietnam, Vietnamese citizens and foreigncitizens marriages are also increasing, especially the marriage of Vietnamese withChinese. This thesis believes that comparative study the different institution of marriagebetween China and Vietnam is very necessary, it could improve Vietnam’s marriage lawlegislation, builds a bridge of communication and cooperation between China andVietnam. Therefore, I choose "A Comparative Study of Chinese and Vietnamese foreigninstitution of marriage" for the master’s thesis topics.China and Vietnam are close neighbors, has a long history of friendly relationship.After the reform and opening up in Vietnam, the economic, trade and cultural exchangesare more often, at the same time, the two citizens intermarriage phenomenon isincreasing fast. However, Chinese and Vietnamese marriages still have many problemsbecause of the different legal institution, such as unregistered marriages. YunnanProvince of china is bounded by Vietnam. There are14border towns. According tostatistics, in late July2012, there are773pairs Chinese and Vietnamese marriage inHonghezhou but only66pairs are registered, childbearing807. Most of them areNon-marital family, their children don’t have identity, land or any other subsidy, and lackof survival skills which make their life are quite difficult. In addition, a lot of illegalmatchmaking appeared, marriage becomes the way to make economic benefits or fashion.The purpose of31percent Vietnam women who married with foreigners is increasingrevenue.15.6%of the marriage is to get money to support their families through. As aresult, thousands of women in a difficult position after marriage, such as, abuse, forcedprostitution etc. The above problems make the children in harsh growing environment. Itis not conducive to the friendly diplomatic relations between China and Vietnam.For these reasons, as a Vietnamese student, I think in the new environment andbackground, a general comprehensive and detailed study in the issues of marriage anddivorce in China and Vietnam is necessary. Such research can improve the legislative andjudicial practice in Vietnam Marriage Law. That’s the reason why I choice this topic.The main content of this section is compare basic principle and Marriage System. For the basic principles, this paper presents the guiding ideology, Legislative purpose andphilosophy of marriage between Chinese and Vietnamese. For marriage system, thispaper comparative studies in the conditions of marriage, marriage programs, invalidmarriage and divorce. The part of article in favor of directed research in the flowingparts.The second part and the third part of this paper are to compare the Chinese andVietnamese foreign marriage and divorce. By a comparative study to identify thesimilarities and differences. This part plays an important role of improving in Vietnamforeign institution of marriage.The final part of this article, by comparing the institution of marriage in China andVietnam, gives the suggestions to improve the Vietnamese Foreign institution ofmarriage. Especially the recommendations for improvement of international divorce,specifically improve international divorce jurisdiction and international divorce lawsapplicably.
