The Study On The Administrative Procedure Law Of Northen Warlords Government

During the period of Northen Warlords Government (1914-1927), China firstestablished the administrative procedure law system. The Administrative ProcedureRegulation (then changed to the Administrative Procedure Law) promulgated in1914wasthe first officially promulgated administrative procedure law in Chinese history, and theAdministrative Court:‘Pingzhengyuan’, was also the first institution to judge theadministrative cases in Chinese history. All in all, the administrative procedure law systemduring the Northen Warlords Government followed Frace and Japan administrativeprocedure law system in Modern Times. It had perfect procedure regulations and courtorgnization regulations, and sometimes reserved the factors of Chinese traditionalsupervisement system, so that it have the color of the times of law change. This papercontains3parts: firstly analysis the theoretical origin and legislative background, espetiallydiscuss the reason why the Northen Warlords Government choose the Continental Lawsystem on administrative procedure. Secondly discuss the main contention of theadministrative procedure law system during the Northen Warlords Government, includingthe procedure regulations and court orgnization regulations. Lastly discuss the features andsignificances of the administrative procedure law system in Northen Warlords Government,combined with some caces, and also discuss the enlightenments to today’s China lawsystem construction.
