With the economic development of, the national strength has been unprecedentedlyincreased. Along with the economic development, there have been many social problems.Uneven distribution of wealth is one more prominent concern among them. Many peoplebecome relatively vulnerable during the process of social differentiation. How to protectthe rights of vulnerable groups has long being the hot spots to explore. It is generallyconsidered that establishing a sound social insurance system is the most important andeffective means. The Social Insurance Law of PRC took effect on July1st,2011. But thereis much to improve from legislation to implementation, such as the lack of legislativeprinciples, excessive delegated legislation and limited coverage. From the perspective ofthe protection of vulnerable groups, this paper briefly discusses the shortcomings of SocialInsurance Law of PRC by comparing social insurance legislation of China with somedeveloped countries, including the U.S.A, UK and Japan, and puts forward somesuggestions for improving of Social Insurance Law of PRC.The first part defines the legal concept of vulnerable groups in order to clear theobjective of this paper which lays the foundation for further study.The second part analyzesthe special status of social insurance in protection of vulnerable groups by comparing withsocial security, social charity and commercial insurance to show the importance andnecessity of the improvement of social insurance law.The third part is a comparativeanalysis of the social insurance system in the U.S.A, UK and Japan, which points out thedeficiency of China’s social insurance law in the protection of vulnerable groups.Thefourth part puts forward some legislative proposals for revising the Social Insurance Lawof PRC, including reflecting more sociality, strictly limiting the scope of delegatedlegislation, reforming of the maternity insurance, expanding social insurance coverage and protecting the collective rights of vulnerable groups.
