On The Constitutional Protection Of The Right Of Network Privacy

"The network right of privacy" as an indispensable basic right of citizens in thismodern information society, not only should be protected by civil law protection, but alsoneed to be implemented in the field of public law, which is the regulation of state power,especially in the field of the Constitution. Strengthen the network privacy right protectedby the constitution, can not only conform to the dignity of human personality as the centerof the human rights protection requirements; defends the infringement to the network rightof privacy form the public power; also help establishing the legal protection system of thenetwork privacy right, with the Constitution as the core of the legal system.In order toperfect the legal protection of network privacy right system, this article has carried on thethorough discussion from the constitution protection’s angle to the network right of privacyquestion. This paper first constructs the elementary theory frame of the network right ofprivacy constitution protection, and then demonstrates the necessity and principles ofnetwork privacy protection of the Constitution. Finally, based on the analysis of the presentsituation and the existing problems in our country,this article proposes the countermeasurein order to perfect our country’s network privacy right constitution protection.The authorhopes that through the construction of the research to the network right of privacyconstitution protection, can restrain the rights of the subject of public power better, andinstructs the related specifically special legislation, then we can construct a legalframework in our country, realize the comprehensive protection in the region of thenetwork right of privacy.
