China's Local Land Financial Analysis Of The Constitution

Since the1990s, with the reform and opening-up process speed up, China’s economic development level increased significantly, and with the industrial and construction have developed rapidly, the growing demand for land is expanding.The local land finance is more and more popular, the land grant fee income accounts for the proportion of local fiscal revenue rapid ascension. The land finance provide huge revenues for local government,and effectively relieve the local financial pressure.But, because of the lack of perfect legal system and powerful supervision system of much of the land illegal crime phenomenon to appear, local government property rights infringement of citizens’ legal incidents, part of the site and landless peasants trampled by the inalienable rights of life.This thesis is divided into six parts, the first part is mainly about important significance of land for human being,and I will explain the value of the land financial from many angles; The second part is maily about the size of the land financial, with lists data to prove the development trend of the land financial; The third part is mainly about the advantage and disadvantage of the land financial, with the syndrome differentiation method, and points out the endanger consequence of relying on land financial; The fourth part mainly analysis of the connotation and theory support of the land financial; The fifth part is the subject of this thesis, using the method of constitutional jurisprudence.The causes of the formation of financial problems are analyzed into three points:constitutional has not been established, relationship between the central and lacal accountability is not clear, legal system is not perfect. Part sixth will give some suggestion to solve the problems of lacal land finance, basically have:Strengthen the citizen participation, to promote democracy; The central government to the local perfect the financial transfer payment system, alleviate local financial pressure; Strengthening the supervision of the people’s congress of financial expenditure, prevent spending inflation; Change the collective land transfer, break the monopoly of the local government.
