The testimony of witnesses is an important form of evidence。This article introduces our country civil litigation witness Development Research and compares foreign provisions on the system of the witness’s testifying before the court. At last, the author puts forward own shallow opinions being established in our legislative and judicial practice.This article has four chapters. Its main structure is as follows:ChapterⅠ:The overview of Civil Witness System. This chapter gives the definition of witness, characteristics and significance of appearing in court as a witness. At the same time, this chapter also elaborate the Anglo-American law system and continental law system as well as our witness concept respectively in detail.ChapterⅡ:The comparison between two big legal system of the hearing of witness system. This chapter focuses on the differences and commons of the two big legal system country the rights and obligations of witnesses to testify in court. For example, the witness has the obligations of telling the truth when appearing in court, and the witness also has the rights to gain the judicial protection and economic compensation and so on.ChapterⅢ:The present situation of our civil litigation witness appearing in court to testify system and the existence problem analysis.This chapter reviews the history of the testifying system in court which has been throughout the whole survival course of the feudal society.ChapterⅣ:The conception of how to improve our civil litigation witness system. This chapter is mainly to improve the witness system, program and method. In the end, the author puts forward his own views, and will try his best to perfect our civil litigation witness appears in court to testify system.
