Research On Internal Distribution Of China Maritime Salvage Reward System

Maritime salvage reward can be fair and reasonable distribution is the key for the development of maritime salvage system long-term health, our country’s "maritime law" just make the provisions of salvage reward external distribution,but did’t make any provisions of salvage reward internal distribution. This paper based on the concepet of "people-oriented" and to the long-term development of maritime salvage system concept, make systemic, comprehensive and further research for the salvage reward internal distribution.The present study guided by the basic therios of economics jurisprudence,law and economics as well as economic law,by full application of the achievements in the studies of economic law and by reference to the achievements in the studies and advanced maritime salvage system in European Union and the United States,Japan and South Korea,by use of scientific ways in the legal studies,the present comprehensive study covers systematic basic theories and the various legal systems in the area of maritime salvage system and provides detailed suggestions for the Maritime salvage system.The paper has three parts, including the introduction, the text, conclusions,the text consists of three chapters:Part1"Introduction" covers the theme and scope of the subjuct,the meaning of the subject.Chapter1introduces the prevailing situation of maritime salvage system in China,by application of the achievements in the studies of economic law and in the light of the features of maritime salvage system,discusses the meaning of the maritime salvage reward,relations with other laws,values,and then puts forward the necessity of salvage reward internal distribution.Chapter2discusses the problem of salvage reward internal distribution between the owner and the crew.,introduces and analyses the current situation between the owner and crew in China, puts forward the principle,operation method and legal relief ways of salvage reward internal distribution aiming at the existing problems, puts forward some suggestions concerning these aspects.Chapter3introduces the problem of cargo owner’s salvage reward. Guided by jurisprudent spirit, the development trend of maritime law and the requirements of market economy, puts forward the basis of the cargo owner’s rights of salvage reward, defines the meaning of endowing the cargo owner’s salvage reward.Part3"conclusions", the last part is the conclusion which is the summary for the full text.
