Research On Legal Issues Of Network Collection

1994, China Charity Federation after the approval of the Chinese government was formally established. After the founding of the China Charity Federation, many charities were set up. Foundation Charity and Red Cross Society become the leading force of charity. The charity cause in china has developed rapidly and achieved certain results.But, at present, the development of China’s philanthropy is still in the relatively backward level. China’s philanthropy development is far behind the developed countries in the west. In twenty-first century, network widely influences people’s daily life, whether the network game, network classroom, or online shopping, electronic government affairs, these are all available through the computer network at a rapid completion. This greatly changed people’s way of life and the way of communication. With the popularity of Internet communication, people’s charity concept change, people look to the efficient and convenient network, it accelerates a new act of charity’s production-network collection. As a new mode of social assistance, network collection has its unique characteristics and advantages.However, every coin has two sides. Network collection also has many legal problems. it’s urgent to make reasonable and effective solution for network collection’s legal issues.This paper is divided into three parts:The first part, generally introduces the basic situation of the network collection. In this part, this paper introduces five aspects:collection, network collection, the background of network collection, the characteristics of network collection and the legal relationship of network collection.The second part, elaborate two aspects:legal issues in network collection and the reason of network collection’s legal issues. In this part, the paper first analysis the legal issues in network, such as the legal vacuum of network collection, network collection lack of supervision, the ownership of the property of network collection is unknown and so on; Second, analysis the reason of network collection’legal issues, including incompletion of the law relating charity, network inherent defect and citizen’s morals decline.The third part, focus on the solution of network collection’s legal problems. This part is the core of this article. In order to solve network collection’s legal problems, First, we should improve the legal system of network, this will enable the network collection behavior having legal basis; Second, the network collection must have a clear legal subjects; Third, determine the ownership of the property of network collection; Fourth, we must establish monitoring and evaluation mechanism of network collection; Fifth, strengthen the government supervision of the network collection.
