Population ageing as a global social issues, in the middle of the last world wasproposed by demographers. Many advanced capitalist countries in the second half ofthe last century has entered the aging society, in the last years of the last century,China formally entered the aging society. The influence of population ageing in manyaspects of the social can not be underestimated, especially for the labor market. Theaging of the labor market in the social state, prone to labor shortages, low productivity,intergenerational conflict significantly and other issues. This paper attempts todistinct groups arising from a legal point of view of an aging society-the elderlyworkers to analyze, reveal the property of the elderly workers legal issues, to clarifythe problems of our country at this stage, Through improved legislation, relevant lawsand regulations, form an effective system, playing a legal regulation of socialbehavior and positive role of social psychology.This article is divided into three parts: Part I is to start by defining articlediscusses the use of related concepts, and to do some sorting out the current state ofChina’s elderly workers, under the premise of a clear scope of the study, analysing theconcept of extension, to determine the status of the elderly workers in China’s legalsystem, and set the tone and direction of the issues discussed in this article. Throughanalysis of the social situation of the elderly workers in China, illustrate this articleattempts to address the problem.The second part is the focus of this article. First of all according to the situationin China, pointed out the problems that the old age workers suffered in China’s legalsystem, as well as the cause of the problem, analyse the necessity and difficulty of theproblem, to further clear the difficulties we should overcome and the goal we shouldachieve in the construction process of the legal system of the elderly workers;Secondly, by Comparative analysing of the extension of the statutory retirement ageand flexible retirement system, to organize our idea of the response of the old ageworkers problem and other related issues, make critical reflection on the system set in accordance with the corresponding ideas, absorb its reasonable connotations, andabandon the unreasonable part; Finally, through the analysis of similar foreign systemlearning their advantages.Part III combines the contents of part I and part II, the author put forward ownviews and opinions on the problems that should be noted In the process of building alegal system for the elderly workers.
