Reflection Of Delay Retirement

In recent years,policy recommendation on retirement age has led to a lively discussion. Since last year, a delay retirement announcement of Tsinghua University led to public confrontation of different emotions. All kind of the date indicates that, China is about to enter the aging country. The pension gap and the disappearance of the major demographic dividend make the country’s pension under increasing pressure. Delay retirement will become an inevitable choice for the future development of China’s pension insurance. However, due to some historical reasons and problems of reality, the practice of this policy has many challenges. This topic mainly focuses on population aging,pension gap increasing, the lack of social security law, the dispute of delay retirement and analyzes the feasibility and necessity of delay retirement. Delay retirement is the inevitable choice of China in current situations, is also in line with the principles of fairness and justice of law. This paper analyzes the implementation of delay retirement may face labor law and social security law obstacle, and we need to modify the relevant laws if we want to do that. In the labor law, we should expand the protection scope of the labor law, improve the old employment environment, actively against age discrimination and carry out flexible retirement system. Aspects of Social security law, we should reform the endowment insurance of dual track system, strengthen the system design, carry out a multi pillar pension insurance system。At same time,we should improve the medical insurance, work-related injury insurance, unemployment insurance and other related systems, which can protect the old workers. This article believes, if we want to delay retirement, the first thing we should do is making a comprehensive scheme of delay retirement,which can reduce social controversy, safeguard legitimate delay retirement program implemented legitimately and reasonably, while guaranteeing the contemporary people’s interests, but also reducing the impact on future generations of pension issues.
